What is Amanita Muscaria?

Amanita muscaria, also known as fly agaric or fairy mushroom, is a psychoactive fungus that grows in the wild. It has been used for thousands of years by shamans and other spiritual practitioners to induce altered states of consciousness. The effects of it have been likened to those of commonly known psychedelics.

Is it legal to sell Amanita Muscaria?

According to Erowid, Amanita Muscaria Mushrooms are not federally regulated in the United States.

This means all parts of the plant and its extracts are legal to cultivate, buy, possess, and distribute (sell, trade or give) without a license or prescription. If sold as a supplement, sales must conform to U.S. supplement laws. If sold for consumption as a food or drug, sales are regulated by the FDA.

When it comes to the state level legislation, however, there is one state that has laws regarding this fungi - Louisiana

Effective Aug 8, 2005 (signed into law Jun 28, 2005) Louisiana Act No 159 makes 40 plants illegal, including Amanita muscaria, when intended for human consumption. The law specifically excludes the "possession, planting, cultivation, growing, or harvesting" of these plants if used "strictly for aesthetic, landscaping, or decorative purposes." In short, this means that Amanita Muscaria is, for the most part, unregulated in the United States, excluding Louisiana, which specifies they must purely be used for artistic/decorative purposes.
